We, Kusch+Co GmbH & Co. KG, take the protection of your personal data very seriously. We respect your rights regarding informational privacy, and will ensure the protection of your privacy.
In the following, we want to inform you about which personal data we collect, for what purposes this is necessary, and the care we take when processing them. Please read this information on data protection regularly, as it is edited from time to time.
1. Our position on data protection
We take special measures to ensure that most of our services are available without the need to collect personal data. Your personal data will only be used in accordance with the legal stipulations or within the scope of a consent agreement provided by you. You have the right to withdraw your consent at any time. Without your express consent, we will not forward your personal data to third parties, except if we are obliged to do by law or by court order.
2. Important terms
Personal data involves all information that enables you to be identified as an individual. In particular, this includes your name, date of birth, address, and phone number.
Due to anonymized data, identification of you as an individual is impossible or requires an extraordinary effort. For example, anonymous data are details you provide about your preferences or similar information. By evaluating these data, which cannot be traced back to you as an individual, we are able to determine the habits of our users, thus permitting us to optimize our website and services, and adapt them to the needs of our users.
3. Which data are collected when you browse our website?
When you visit and browse through our website, our server logfiles automatically collect and store certain information that is provided by your Internet browser. These are:
- Browser type and version
- Technical specifications of your PC (operating system, display screen resolution, JavaScript settings, etc.)
- Referrer URL (the previously visited website)
- Host name of your PC (IP address)
- Time when the page was visited
- The complete URL (address) of the pages you visit on our website
None of these data can be assigned to you personally, as they are not linked to other data sources. Collection and storage of these data is a standard and necessary procedure to ensure reliable server operation (e.g. fault diagnosis in case of problems, etc.), and for creating general access statistics for the purpose of improving and optimizing our Internet service.
4. Which personal data do we request from you?
On principle, we do not request more personal data than is absolutely necessary. For example, registration is essential for certain services. For this, we typically ask for your name, address, and e-mail address, your date of birth, your gender, and your phone number. Sometimes, additional data is required, e.g. when entering your home town in a route planner or for a weather forecast. Occasionally, you might be asked for additional information in surveys, etc.
5. Who collects my data?
All of the information you provide on our website is stored exclusively in our own databases, except if you are expressly informed otherwise. In these cases, you will always be informed about who collects your data, and you can always decide whether the data you give to one of our partners may also be transferred to us. We point out that companies with which we cooperate, as well as other Internet sites and services that are accessible from our website might possibly also collect data about your person. These companies have their own privacy policies and data protection regulations, which are independent from this privacy statement.
6. What do we do with your personal data and the anonymous data?
In most cases, we need your personal data to provide the relevant services you request. Moreover, the data provided by you enable us to prepare anonymized statistical surveys about user habits, thus permitting us to standardize our services and adapt them to the needs of our users.
7. Can you decide how we use your data?
Of course you have the sole right to decide whether and for what purposes we may use your data. For example, various services include the option to receive a newsletter with specific information. You can cancel this service at any time. Usually, there a link is provided at the end of the newsletter, with which you can cancel the newsletter very conveniently.
Furthermore, you alone decide whether your data can be transferred to third parties or whether we can use your data for the purpose of consultation, promotion, and market surveys. Also here, you can cancel your agreement at any time, of course.
Similarly, you can influence the use of cookies (see Item 7 below for details about cookies). By making suitable adjustments in your Internet browser (usually under "Options" or "Adjustments" in the browser menu) you can decide whether all cookies will be accepted, whether you are informed every time a cookie is installed, or even to refuse all cookies. However, if you decide not to accept cookies, this can result in functional restrictions of the offers on our website. Thank you for your understanding.
8. Do we transfer your data to third parties?
We neither sell nor lend user information, except if you given your express agreement. Only in exceptional cases does the provision of a service depend on the transfer of your data to one of our partner companies. In these cases, you will be informed accordingly before we collect your data, and you can decide whether your data may be passed on or whether you prefer not to make use of the service offered.
Occasionally, private persons ask us to disclose the identity of our users. We never disclose the personal data of our users, except if we are legally obliged to do so. This could be the case if government institutions (e.g. law enforcement agencies) request such information or if we receive a corresponding court order. In all other cases, your identity is kept confidential.
9. Can you check, correct, or delete your data?
Provided you have registered with us for a particular service, you will be provided with a user name and a password. These enable you to access your personal data, which you can change and/or delete. By deleting the data, you will no longer receive the relevant service. However, regarding data collected within the scope of our free services, we are legally entitled – and sometimes obliged – to store the data for longer periods (e.g. for invoicing purposes) in accordance with the legal regulations.
10. What are cookies?
Cookies are small text files that are transferred to the hard disk of your PC from a web server via your browser. They contain information about which pages you visited on a website and when, and they can only be accessed and read by the server that sent them. By means of cookies it is possible to make more effective use of the Internet and the website. Cookies are generated in accordance with defined industrial standards. Numerous Internet providers use them to offer their customers additional and useful functions. Cookies do not collect any personal data – only the IP address is stored anonymously to identify the computer.
If don't want us to identify your PC with a cookie, you can adjust your browser to prevent cookies being stored on your hard disk. See Item 5 above for details on how this is done.
11. Which technical measures do we undertake to protect your data?
We use secure data networks, which are fitted with firewalls to industrial standards, and have password protection. We protect the personal data that you provided against loss, destruction, manipulation and unauthorized access. Especially in sensitive areas such as processing credit card data, we maintain very high safety standards to ensure that your data are protected. Wherever credit card data must be transferred, this is only done with the most modern encryption methods. Only selected employees have access to the data that you have provided. Moreover, these selected employees are informed in writing about observance of the Federal Data Protection Act and the confidential treatment of personal data. We have implemented all necessary technical and organizational steps to protect your personal data.
